These Terms of Service ("Terms") govern your use of the SkillTiles platform ("Service"), operated by SkillTiles Pty Ltd (ABN pending) ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
We are based in Australia and these Terms are governed by the laws of New South Wales, Australia.
These Terms are intended to be transparent and fair. We have drafted them with the requirements of the unfair contract terms provisions of the Australian Consumer Law in mind, including the stricter penalties effective since 9 November 2023.
SkillTiles is an online learning platform that delivers bite-sized, AI-generated educational content ("Tiles") across a variety of topics. The Service is available via web browser on desktop and mobile devices.
We may update, modify, or discontinue any feature of the Service at any time. We will endeavour to provide reasonable notice of significant changes.
You may use certain features of the Service without an account. To access premium features, you must create an account using a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
SkillTiles offers both free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Stripe. All prices are displayed in your local currency and include applicable taxes.
Automatic renewal: Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We will clearly disclose all costs, the renewal frequency, and the renewal price before you subscribe.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. There are no cancellation fees, lock-in periods, or unreasonable barriers to cancelling. Cancellation takes effect at the end of the current billing period — your access continues until the period ends.
Free trials: If we offer a free trial, we will notify you before the trial ends and your paid subscription begins. You can cancel during the trial at no cost.
Pricing transparency: All pricing is displayed upfront before checkout. We do not engage in drip pricing or hidden fees.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
If the Service fails to comply with a consumer guarantee, you are entitled to remedies including repair, replacement, or refund as required under the Australian Consumer Law. Any clause in these Terms stating "no refunds" does not apply where a refund is required by law — your statutory rights always take precedence.
Digital services, including SaaS platforms like SkillTiles, are covered by the same consumer guarantees as physical goods. Our services are guaranteed to be of acceptable quality, fit for their stated purpose, and matching their description.
We acknowledge that under the Australian Consumer Law, standard form contract terms that cause a significant imbalance in rights and obligations, are not reasonably necessary to protect our legitimate interests, and would cause detriment to you may be declared unfair and void by a court. We have designed these Terms to be transparent, balanced, and fair.
If any term is found to be unfair, it will be severed from these Terms and the remaining terms will continue to apply.
Learning content on SkillTiles is generated with the assistance of artificial intelligence. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. The content is provided for educational purposes only and should not be relied upon as professional, legal, medical, or financial advice.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these Terms, provided we give you reasonable notice and an opportunity to remedy the breach where practicable.
All content, design, code, and trademarks on SkillTiles are owned by or licensed to SkillTiles Pty Ltd. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
Any content you submit (such as topic suggestions) grants us a non-exclusive, royalty-free licence to use that content within the Service.
To the maximum extent permitted by law (and subject to your rights under the Australian Consumer Law), SkillTiles is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, profits, or learning progress.
Our total liability to you for any claim arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim. This limitation does not apply to the extent it would contravene the Australian Consumer Law.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth).
We may update these Terms from time to time. If we make material changes, we will notify you via the email address associated with your account or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use after changes take effect constitutes acceptance of the updated Terms.
If you have a dispute with us, please contact us first at support@skilltiles.com so we can attempt to resolve it informally. We aim to respond to all disputes within 14 days. If we cannot resolve the dispute, it will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
